On Approval of Terms and Conditions for Passage of Professional Training Courses at the LEPL Training Centre of the Ministry of Corrections, Probation and Legal Aid


Pursuant to the article 91.2 of the law of Georgia “On Rules of Non-custodial Sentences and Probation” and article 6.14 of the Presidential Decree # 832 (October 15, 2010) “On Approval of Rules for Public Service in the System of Imprisonment and Execution of Custodial Sentences”,

I ORDER:


Article 1. Rules and conditions for passage of professional training courses at the Legal Entity of the Public Law under the Ministry of Corrections, Probation and Legal Aid to be approved in a form given below.


Article 2. Given Order shall come into force immediately upon publishing.

Terms and Conditions for Passage of Professional Training Courses at the LEPL Training Centre of the Ministry of Corrections, Probation and Legal Aid


Article 1. General Provisions


Forms of the training process, rules and conditions for admission, knowledge evaluation system and criteria shall be defined and regulated by the Rules and Conditions for passage of training course of the LEPL Training Centre for Corrections, Probation and Legal Aid (hereinafter Training Centre) under the management structure of the Ministry of Corrections, Probation and Legal Aid of Georgia.



Article 2. Teaching Process of the Training Centre


1. The Training Centre shall deliver following training courses:


a. Specialized training for employees of the Staff of the Ministry;


b. Initial basic training for employees of the system of imprisonment and execution of custodial sentences;


c. Specialized training courses for employees of the system of imprisonment and execution of custodial sentences


d. Initial basic training for employees for execution of the non-custodial sentences (hereinafter National Probation Agency)


e. Specialized training for employees of the National Probation Agency


f.Specialized training for candidates to promotion


g. Specialized training on rules for use and storage of firearms


2. The Training Centre shall be authorized to deliver training courses and internship (i.e. practical courses) for employees of other agencies based on the relevant agreement.


3. Type of the training programme, course duration, beginning and recess times, types, as well as number of classes, shall be determined by the Director of the Training Centre by individual administrative legal act.



Article 3. Rules and Conditions for Admission of Students to the Training Courses


1. Candidates to be appointed to the Imprisonment and Execution of Custodial Sentences or those appointed for the term of 6 probation months, shall be admitted to the Initial Basic training for employees of the imprisonment and execution of custodial sentences system.


2. Candidates to be appointed to the National Probation Agency and/or those appointed for the terms of 6 probation months shall be admitted to the Initial Basic training courses for employees of the National Probation Agency.


3. Initial basic preparation course for employees of Imprisonment and Execution of Custodial Sentences and the National Probation Agency includes theoretical, practical, physical and tactical courses.


4. Initial Basic training for employees of Imprisonment and Execution of Custodial Sentences and the National Probation Agency shall start within 10 days after receiving the written list of students.


5. Subject to successful passage of the basic training course by incumbents – employees of the Imprisonment and Execution of Custodial Sentences and the National Probation Agency – incumbents shall be sent to additional 14-days practical course to the agency for Imprisonment and Execution of Custodial Sentences or the National Probation Bureau.


6. After successful completion of the training programme, the contract is signed with the student concerned. One of the mandatory requirements of the contract is to work in the given position for at least 2 years after successful completion of the training programme.


7. Passage of the Initial Basic training is not mandatory for the Chairperson, his/her Deputy of Penitentiary Department, Director and Deputies of the Imprisonment and Custodial facilities, Head of Department and structural units. In addition, same is not mandatory for the Head of the National Probation Agency, his/her Deputies and heads of structural units.


8. Acting employees of the Ministry Staff, Imprisonment and Execution of Custodial Sentences Agency, the National Probation Agency shall be eligible to attend specialized and development courses.


9. Acting employees (students) attending development courses shall be excluded from courses in case of their dismissal.


10. Students shall observe internal regulations of the Training Centre.



Article 4. Evaluation System of Students of the Training Centre and Criteria


1. Student attending Initial Basic programme shall be assessed in 3 components: attendance of classes, interim results and tests. Certificate of the Training Centre shall be issued to the student accumulating at least 75 out of total of 100.


2. At the Initial Basic training, students have to also meet certain sports normative. Also, students learn tactics. Exams are assessed by the instructor based on the given task. Evaluation for tactics exams is “passed” “did not pass”.


3. Rules for teaching and passing sports normative and tactics shall be determined by the Director of the Centre by the individual administrative legal act.


4. Supervisor (relevant authorized person) of practical classes develops written reports about each student, describing his/her personal and professional properties and compliance with the position. Reports shall be sent to the Director.


5. Firearm (shooting) practical classes shall be assessed by “passed” /”did not pass” mark.


6. Director of the Training Centre determines the evaluation system (exam or test) separately in all individual cases by the individual administrative legal act for students, attending specialized training courses and/or development programmes. At the end of the course the students sit exams or tests.


7. In test defined in accordance with the training course, which implies the test paper only, the student shall accumulate 75% out of total number of test questions.


8. Students shall have a right to repeatedly (once) sit an exam or test.


9. Rules and conditions for attendance of classes, interim tests and testing shall be determined by the Director of the Training Centre by the individual administrative legal act.


10. Following successful completion of the training course, the relevant certificate is awarded to the student. Rules for awarding certificates shall be determined by the Director of the Training Centre by the individual administrative legal act.


11. Results of initial basic and specialized courses shall be sent to the chairperson of the Penitentiary Department and/or Head of the National Probation Agency, and results of specialized development trainings delivered to staff of the Ministry shall be sent to the Minister of Corrections, Probation and Legal Aid. Failure to pass the training course may be used as grounds for dismissal or rejection of appointment.


12. The Monitoring group - composition of which, as well as evaluation criteria, shall be determined by the Minister of Corrections, Probation and Legal Aid - shall provide for examination and evaluation of personal and professional skills of student during the programme.
